Terms and conditions
DRAFT — waiting for a lawyer's review. It will change before launch.
1. About these terms
These terms are an agreement between you and [company name] Ltd, a company registered in England and Wales (company number [number], address [address]) ("we", "us").
They cover the Guard computer app, the phone app, the parent dashboard and our servers (together, "Guard"). By making an account or using Guard, you agree to these terms and to our privacy policy. If you do not agree, do not use Guard.
2. Guard is a helper
Guard does not replace a parent's care. There is no promise that it catches every sound.
Guard is not a medical device and does not monitor health. Movement alerts only say that movement was detected in the room. They say nothing about health or how your child is.
How well Guard works depends on the room, the microphone, the distance, other sounds, your recordings and your settings. Alerts may be missed, late or wrong.
Do not use Guard as the only way to watch your child. Always check on your child yourself.
3. What it needs to work
The computer must be on, not in sleep mode, with a working microphone and internet. Notifications must be on for your phone and must not be blocked by battery or focus settings.
Alerts travel through services we do not control: your internet provider, Google, Apple, Microsoft and Expo. If the computer stops sending a signal, we try to send a "Monitor OFF" alert. This alert also depends on those services; we cannot promise it always arrives or arrives on time.
4. Test phase, features and price
Guard is in testing now. It is given "as is" and "as available".
We may add, change, limit, pause or remove any feature at any time, also features marked "test", and also for accounts that already use them.
Guard is free during testing. We may add paid plans or paid features later. You never pay anything before you agree to a price.
5. Your account
You must be at least 18 years old. One account is for one person.
Keep your phone, your Google account and your sign-ins secure. You are responsible for what happens in your account, unless it happens because of our fault.
Check who can see your monitors. If you see a parent you do not know, remove them on the computer's Phone link page and choose "Sign out everywhere".
6. Using Guard the right way
Guard is only for listening to your own child in your own home.
You are responsible for telling other people in the home (a nanny, guests) that the room is monitored, and for following the laws of your country on recording sound.
Do not use Guard to listen to another adult without their knowledge, to break the law, or to harm others. Do not copy, change or reverse-engineer Guard, except where the law allows it. Do not try to break into or overload our servers.
7. Who owns what
We own Guard and all rights in it. We give you a personal, non-transferable right to use it under these terms. Guard is licensed to you, not sold.
If you send us ideas, suggestions or feedback, we may use them freely, without paying you or naming you.
8. Our responsibility
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. You also keep your legal rights as a consumer.
As far as the law allows, we are not responsible for: losses we could not foresee; losses caused by things outside our control (power cuts, internet or phone problems, third-party services, your settings or devices); losses caused by not following these terms; business losses.
As far as the law allows, our total responsibility to you for everything is limited to the higher of £50 or the amount you paid us in the 12 months before the claim.
9. Other companies' services
Guard uses services from other companies (for example Google, Apple, Microsoft and Expo), and the app stores have their own terms. We are not responsible for their services, their outages or their terms.
10. Changes to these terms
We may change these terms at any time, for example for new features, new laws or new prices.
For important changes we tell you in the app or by email at least 14 days before they apply. Changes needed by law or for security may apply at once.
If you do not agree with a change, stop using Guard and delete your account. If you keep using Guard after the change applies, you accept the new terms.
11. Pausing or ending
You can delete your account at any time in the app.
We may pause or close an account at once if it breaks these terms, puts other people at risk, or if the law requires it.
We may stop Guard or a part of it for everyone. Where we can, we tell you at least 30 days before.
12. Transfer
We may transfer our rights and duties under these terms to another company, for example if our business is sold or merged. Your rights under these terms stay the same. You may not transfer your account or these terms.
13. Law and courts
These terms are under the law of England and Wales. Disputes go to the courts of England and Wales.
If you are a consumer living in another country, you keep the protections of your home country's law that cannot be changed by agreement, and you may also bring a claim in your home country (in Turkey: consumer arbitration committees and consumer courts).
14. Other
If a court finds a part of these terms invalid, the rest stays in force. If we do not use a right at once, we do not give it up.
These terms and the privacy policy are the whole agreement between you and us about Guard. Contact: [email address — added before launch].
